1. Introduction and Scope
O'Hare's Grille & Pub ("we," "us," or "our"), respects your privacy. This Privacy Policy describes the personal information we collect, the sources from which we collect it, how we use it, with whom we share it, and the choices and rights you may have. It applies when you:
- visit our website at https://www.oharesgrillepub.com/ (the "Site");
- use our mobile application (the "App");
- make a reservation, join our waitlist, place an order, join our mailing or text list, create a guest account, or leave ratings or reviews on our menus;
- communicate with us, including by email, text message, phone, social media, online forms you submit through the Site or App (such as contact, feedback, catering, or private event inquiry forms); or
- otherwise interact with us where this Privacy Policy is posted or referenced (together, the "Services").
2. Information We Collect
"Personal information" means information that identifies you or could reasonably be linked to you. Depending on how you interact with us, we collect the following categories of personal information:
- Contact and profile information. Name, postal address, email address, telephone number, birthday, wedding anniversary, and a profile photograph if you choose to upload one.
- Account information. Username and password for the guest account you may create through our Services. If you create an account using a third-party login (such as Google or Facebook), we receive the information that your privacy settings on that service permit, in order to create your account.
- Content you submit. Ratings, written reviews, photos, survey responses, and other content you choose to post or send to us.
- Reservation, waitlist and order information. Reservation, waitlist and order history and frequency; items ordered; transaction amounts; pickup or delivery details; and any special instructions you provide with a reservation, waitlist signup or order.
- Dietary and dining preferences. Dietary and dining preferences you choose to share with us, such as allergen information or dietary restrictions, which we use to serve you better. Because these preferences can reveal information about your health, religious beliefs, or disabilities, some states treat them as sensitive personal information; see Section 12 for how we handle them and your choices.
- Loyalty, rewards, and gift card information. Your participation and status in our loyalty or rewards program (such as points balances and redemptions) and information about gift cards you purchase, send, or receive (such as card values and balances).
- Payment information. Order payments are processed by our third-party payment processor. This includes payments you make using a digital wallet such as Apple Pay or Google Pay, if offered. We do not store your full payment card number. We receive limited transaction information (such as the card type, the last four digits, and confirmation of payment) needed to fulfill and support your order.
- Device and usage information. Information about the devices you use to access the Services (such as IP address, device, browser, and operating system type, and user settings); the pages and URLs that direct you to the Site, that you visit before arriving, and that you exit to; dates and times of your visits; and information about actions you take on the Services, such as page views, time spent on pages, searches, and navigation patterns. Your interactions with the Services (such as clicks, scrolling, and form navigation) may also be visually recorded and replayed by us and our platform provider to diagnose problems and improve the Services (often called "session replay").
- General location information. A general geographic location (such as country and city) inferred from your IP address.
- Inferences and preferences. Preferences and inferences we draw from the information above, such as favorite menu items or visit patterns, used to personalize our offerings and communications.
- Communications. The contents of messages you send us, your communication preferences, and records of whether marketing messages we send have been received, opened, or read.
3. Sources of Personal Information
- Directly from you, when you make a reservation, add your name to a waitlist, place an order, create an account, post a rating or review, sign up for emails or texts, complete a form, or contact us.
- Automatically, through cookies and similar technologies when you use the Site or App, as described in Section 9, and as provided to us by your device's operating system.
- From other services we use, such as our point-of-sale system, reservation platform, delivery marketplaces, or prior marketing providers, when we import guest information into our marketing and guest-management tools.
4. How We Use Personal Information
- To provide the Services, including to process, fulfill, and communicate with you about your reservations, waitlist signups, orders; maintain your guest account; and display your ratings and reviews.
- To send you marketing and promotional communications, including emails and (with your consent, as described in Section 5) text messages about menu items, events, specials, and news. Some of our routine marketing emails are scheduled and sent automatically, and some of our marketing content is drafted with the assistance of automated and AI-based tools. You can unsubscribe at any time.
- To personalize the Services and our communications, such as remembering your preferences and highlighting items we think you will enjoy.
- To operate, maintain, analyze, and improve the Site, the App, and our business — including monitoring and analyzing usage, troubleshooting, and developing new offerings.
- To protect against and prevent fraud, unauthorized transactions and access, and other liability, and to manage risk.
- To comply with legal requirements, enforce our terms and policies, and respond to legal process and requests from authorities.
- For other purposes described to you at the time of collection or with your consent.
5. Text Messages
Marketing Texts. If you opt in to our marketing text message program, we will send you recurring marketing and promotional text messages, which may be sent using an automated system for the selection of telephone numbers. Consent to receive texts is not a condition of any purchase. Message frequency varies. Message and data rates may apply. Reply STOP to any message to opt out or HELP for help.
Transactional Texts. Separately from any marketing text program, we send transactional messages about requests you initiate. When you use your phone number to make a reservation, join our waitlist or place an order, we will send you texts about that request, such as reservation, waitlist and order confirmations, pre-arrival reminders, place-in-line updates, table-ready alerts, order status updates and delivery status updates. These are informational messages, not marketing messages, and they stop when the transaction is complete. Message and data rates may apply. Reply HELP for help.
Mobile Information and Text Messaging Consent. No mobile information will be shared with or sold to third parties or affiliates for marketing or promotional purposes. Text messaging originator opt-in data and consent will not be shared with any third parties. Our messaging service providers process this information on our behalf solely to deliver the messages you have requested; they act as service providers for us and are not to be considered third parties for purposes on this privacy policy. Your consent to receive text messages from us is an agreement between you and us and is not transferable. We keep records of your phone number, your opt-in, and your opt-out requests in order to operate our text message programs and honor your choices.
6. How We Share Personal Information
We share personal information with the following categories of recipients:
- Popmenu, our technology platform provider. When you use, or submit information through, our Popmenu-powered Site, App, menus, or ordering tools, you provide that information to both us and Popmenu. Popmenu processes personal information as a service provider on our behalf to operate the Services, and also collects and uses certain information on its own behalf as an independent business, for example, to operate, evaluate, improve, and market its own services, to develop new services, and to analyze restaurant-industry trends. Popmenu's independent practices are described in Popmenu's own privacy policy, available at https://my.popmenu.com/privacy. We are not responsible for Popmenu's independent use of your information, and we encourage you to review Popmenu's privacy policy.
- Payment processors. When you pay for an order, your payment information is collected and processed by our third-party payment processors.
- Delivery providers. If you choose delivery, we share your name, delivery address, phone number, and order details with our third-party delivery providers to make the delivery.
- Service providers. Other vendors that perform services for us. These providers are permitted to use personal information only to perform services for us.
- Legal, safety, and compliance recipients. We may disclose personal information if we believe in good faith that disclosure is necessary to comply with law, regulation, legal process, or governmental request; to enforce our terms and policies; or to protect the rights, property, or safety of our business, our guests, our employees, or others.
- Business transfers. Personal information may be transferred to a buyer or successor in connection with a merger, acquisition, financing, reorganization, bankruptcy, or sale of some or all of our assets.
All the above categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.
7. Ratings, Reviews, and Other Public Content
The ratings and reviews features of our menus are designed for public consumption. Ratings and reviews you submit are visible to the public, and the display name (or handle) and photo associated with your guest account may be displayed alongside your reviews. Please do not include information in a review that you do not want to be public. Ratings and reviews are stored and displayed through the Popmenu platform and may remain available through that platform as described in Popmenu's privacy policy even if our relationship with Popmenu changes.
8. Your Choices
- Email. Unsubscribe from marketing emails by using the unsubscribe link included in every marketing email. We may still send you transactional messages (such as order confirmations).
- Text messages. Reply STOP to any marketing text from us to stop receiving marketing texts from us.
- Guest account. If you have a guest account, you can log in through our Site to update your name, email address, birthday, and photo and to manage your email subscription preferences.
- Deletion. You may request deletion of your guest account and personal information as described in Section 12. Some information may be retained or deidentified as permitted or required by law.
- Cookies and tracking. See Section 9 for cookie and interest-based advertising choices.
- App permissions and notifications. You can disable notifications and revoke device permissions at any time in your device settings. You can also request deletion of your account from within the App as described in Section 10.
9. Cookies and Tracking Technologies
Like most websites and apps, the Services use cookies and similar technologies. A "cookie" is a small data file placed on your device that helps the Services function and helps us understand how they are used. The Services use:
- Essential and functional cookies, including persistent cookies that remember your preferences, settings, and login between visits, and session cookies that enable features while you browse and are deleted when you close your browser. Some features of the Services may not function properly without cookies.
- Analytics technologies, operated by third-party analytics providers that place their own cookies to collect traffic and activity data and provide us with usage metrics (such as Google Analytics, Snowplow and FullStory), including session-replay tools that visually record interactions with the Services (such as the ordering and checkout flow) as described in Section 2.
Most browsers let you erase cookies, block all cookies, or warn you before a cookie is set.
Our Services do not respond to browser "Do Not Track" signals, for which no industry standard has been adopted.
10. Our Mobile App
This Privacy Policy applies to our App, which is powered by the Popmenu platform. In addition to the practices described above:
- Device permissions. The App may request access to device features such as notifications. You can grant or revoke these permissions at any time in your device settings.
- App usage information. When you use the App, our servers automatically record information that your device sends, including device model and identifiers, operating system information, user settings, and information about your use of the App, which we use to provide and improve the Services. The App also sends crash reports in the event of an error, which we use for analysis and troubleshooting.
- App analytics. The App uses third-party analytics services, including Google Analytics and Snowplow, which collect app-level information such as installs, updates, and performance, and FullStory, which records your interactions with the in-App ordering flow (session replay) as described in Sections 2 and 9. Because the App's ordering experience is powered by the same technology as our website, the cookies and analytics described in Section 9 also operate within the App.
- Account deletion. If you created an account in the App, you can delete your account from within the App at Profile > Delete. Section 12 describes how deletion requests are handled and what may be retained.
11. Data Retention
We retain personal information for as long as reasonably necessary for the purposes described in this Privacy Policy, unless a longer period is required or permitted by law. The criteria we use to determine retention periods include: the duration of our relationship with you (for example, while your guest account remains active or you remain subscribed to our communications); whether the information is needed to provide the Services, maintain business records, or handle disputes; and our legal, tax, accounting, and audit obligations. When personal information is no longer needed, we delete, deidentify, or aggregate it.
12. U.S. State Privacy Rights
Depending on where you live, you may have some or all of the following rights with respect to your personal information, subject to legal limits and exceptions:
- Right to know / access. To confirm whether we process your personal information and to access it, including (where applicable) the categories collected, the sources, the purposes, and the categories of recipients.
- Right to portability. To obtain a copy of personal information you provided to us in a portable format.
- Right to correct. To correct inaccurate personal information.
- Right to delete. To request deletion of your personal information.
- Right to opt out. To opt out of the "sale" or "sharing" of personal information, of "targeted advertising," and of certain "profiling," as those terms are defined under applicable state laws.
- Right to limit use of sensitive personal information / consent rights. To limit certain uses of sensitive personal information or, in some states, to require consent before it is processed.
- Right to non-discrimination. Not to receive discriminatory treatment for exercising your rights.
Sensitive information. We use sensitive personal information such as dietary or dining preferences you choose to share (which can reveal information about health, religious beliefs, or disabilities) only to provide and personalize the Services you request and for other purposes permitted by applicable law, and not to infer characteristics about you. Where applicable law requires consent to process sensitive information, by choosing to provide your dietary or dining preferences or enabling location features, you consent to our use of that information for these purposes. You may withdraw consent at any time by deleting the preferences from your profile or disabling location permissions in your device settings; withdrawal does not affect processing that occurred before you withdrew.
How to Submit a Request
You (or, where permitted, your authorized agent) may submit a request by emailing ohares17@gmail.com, calling (505) 896-0123. We will need to verify your identity before acting on most requests, which may require you to confirm information we have on file (such as the email address or phone number associated with your account or orders). We will respond within the time required by applicable law (generally 45 days, with extensions where permitted). If we deny your request in whole or in part, you may appeal by replying to our decision email with "Appeal" in the subject line, and if your appeal is denied, you may contact your state attorney general.
Additional Information for California Residents
This subsection supplements the rest of this Privacy Policy and applies to California residents. It is provided pursuant to the California Consumer Privacy Act, as amended by the California Privacy Rights Act ("CCPA").
Categories of personal information. In the preceding 12 months, we have collected the categories of personal information identified in the table below, from the sources described in Section 3, for the purposes described in Section 4, and disclosed them for business purposes to the categories of recipients described in Section 6, as summarized below:

We do not "sell" personal information, and we do not "share" personal information for cross-context behavioral advertising, as those terms are defined under the CCPA. We have no actual knowledge that we sell or share the personal information of consumers under 16 years of age.
Shine the Light. California Civil Code § 1798.83 permits California residents to request information about disclosure of personal information to third parties for those parties' direct marketing purposes. We do not disclose personal information to third parties for their own direct marketing purposes.
13. Children's Privacy
The Services are not directed to children, and we do not knowingly collect personal information from children under 13. If we learn that we have collected personal information from a child under 13, we will delete it as soon as possible. If you believe a child under 13 has provided us personal information, please contact us at ohares17@gmail.com.
14. Security
We and our service providers use reasonable administrative, physical, and technical safeguards designed to protect personal information from unauthorized access, disclosure, use, alteration, or destruction. No security measures are perfect, however, and no method of data transmission or storage can be guaranteed to be secure. Please protect your account credentials and notify us promptly of any suspected unauthorized use of your account.
15. Changes to This Privacy Policy
We may update this Privacy Policy from time to time to reflect changes in our practices or in applicable law. We will post the updated policy on this page and revise the "Last Updated" date above. If we make material changes, we will provide additional notice as required by law, such as a notice on our Site or App or an email to the address on file. Your continued use of the Services after an update means the updated policy applies to you.
